Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ChargeStack website and services (collectively, the "Services") operated by ChargeStack, LLC ("ChargeStack," "we," "us," or "our"), a Montana limited liability company.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By creating an account or using the Services, you confirm that you:

• Are at least 18 years of age
• Have the legal capacity to enter into these Terms
• Agree to comply with all applicable laws and regulations

2. Description of Services

ChargeStack provides tools for Montana criminal justice professionals, including:

• Montana DOC Data Browser for exploring public sentencing records
• Additional tools and features as they become available

Services are provided "as is" and may be modified, suspended, or discontinued at any time without notice.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and current information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to:

• Use the Services for any unlawful purpose or in violation of any laws
• Attempt to gain unauthorized access to systems or data
• Interfere with or disrupt the Services or servers
• Upload malicious code, viruses, or harmful content
• Scrape, harvest, or collect data from the Services using automated means without permission
• Impersonate others or misrepresent your affiliation
• Use the Services to harass, threaten, or harm others

5. Data and Content

Public Data: The Montana DOC data provided through our Services is sourced from publicly available government records. We do not guarantee the accuracy, completeness, or timeliness of this data.

User Data: You retain ownership of any data you submit. By using the Services, you grant us a license to use, store, and process your data solely to provide the Services.

6. Intellectual Property

The Services, including all software, designs, text, graphics, and trademarks, are owned by ChargeStack or our licensors. You may not:

• Copy, modify, or create derivative works
• Reverse engineer or decompile the software
• Remove or alter any proprietary notices

7. No Legal Advice

ChargeStack is not a law firm and does not provide legal advice. The information and tools provided are for informational purposes only. You should not rely on our Services as a substitute for professional legal counsel.

Any information obtained from the Services should be independently verified. We are not liable for decisions you make based on information from the Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or availability
• Warranties that the Services will be uninterrupted or error-free

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARGESTACK SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Decisions made based on information from the Services

Our total liability to you for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless ChargeStack, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights

11. Third-Party Services

The Services may contain links to third-party websites or integrate with third-party services (e.g., Firebase, Google Analytics). We are not responsible for the content, privacy practices, or terms of third-party services.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and data
• Provisions regarding liability, indemnification, and dispute resolution will survive

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Montana. You consent to the personal jurisdiction of such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a new effective date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

15. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChargeStack.

Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment: You may not assign these Terms. We may assign our rights and obligations without restriction.
